The website www.diversifiedmachine.us has been seized by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), in accordance with a seizure warrant obtained by the United States Attorney’s Office for the Eastern District of Michigan.
It is a violation of federal law to manufacture, receive, transport, and/or deliver a silencer not registered in the National Firearms Registration and Transfer Record (NFRTR) (26 USC §§ 5861(a),(d),(e),(f), and (j)).
The possession of a silencer (to include silencer parts and kits) sold by Diversified Machine is a violation of federal law.
Only special occupational taxpayer (SOT) manufacturers, importers and makers may lawfully register a silencer in the NFRTR, and they may only do so if it is registered prior to the importation, making or transferring of the item (26 USC § 5841).* Therefore, a silencer that is registered by anyone else and/or at any other time is unlawful and will be removed from the NFRTR.
If you are in possession of a silencer sold by Diversified Machine you should contact your nearest ATF office, or call 1-800-ATF-GUNS.
* On or about December 8, 2021, a written warning was sent to customers of Diversified Machine that stated:
[Y]ou cannot lawfully possess a silencer without first being a special occupational taxpayer and having the silencer registered in the NFRTR.
This statement should have read:
You cannot lawfully possess a silencer without having the silencer registered in the NFRTR, with the exception of special occupational taxpayers who may possess unregistered silencer parts during the silencer manufacturing process.
